1. About these terms

These Terms of Use (“Terms”) govern your use of the WorkRight website at getworkright.com.au and the employment compliance health check tool (“the Service”). By using the Service, you agree to be bound by these Terms.

WorkRight is operated by Sacha Smith. References to “we”, “us”, or “our” mean WorkRight.

2. The Service

WorkRight provides an online employment compliance health check that assesses your business against current Australian employment law obligations. The health check generates a scored compliance gap report based on your responses.

4. Accuracy of information

We make reasonable efforts to ensure the legislative references and compliance information in the Service are accurate and current as at the date of publication. However:

• Employment law changes frequently — legislation, regulations, Awards, and case law are updated regularly
• The health check uses generalised assessment criteria that may not capture every nuance of your specific situation
• Your compliance gap report is only as accurate as the information you provide

We do not warrant that the information is complete, accurate, or up to date at all times.

5. Your responsibilities

When using the Service, you agree to:

• Provide truthful and accurate responses to the health check questions
• Use the Service for lawful business purposes only
• Not attempt to reverse-engineer, copy, or reproduce the health check methodology
• Not use automated systems (bots, scrapers) to access the Service

6. Intellectual property

All content on the WorkRight website — including text, design, logos, graphics, health check questions, scoring methodology, and gap report templates — is owned by WorkRight or its licensors and is protected by Australian copyright law.

You may not reproduce, distribute, or create derivative works from our content without prior written consent.

7. Limitation of liability

To the maximum extent permitted by law:

• WorkRight is not liable for any loss, damage, or expense arising from your use of, or reliance on, the Service or the compliance gap report
• This includes (without limitation) any penalties, fines, claims, or legal proceedings that may result from compliance gaps identified or not identified by the Service
• Our total liability to you for any claim arising from the Service is limited to the amount you paid for the Service (for the free health check, this is nil)

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

8. Third-party links

The Service may contain links to external websites, including government resources such as the Fair Work Ombudsman and Safe Work Australia. We are not responsible for the content or practices of external websites.

9. Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend or modify the Service at any time without notice for maintenance, updates, or other reasons.

10. Changes to these terms

We may update these Terms from time to time. The “Last updated” date at the top indicates the most recent revision. Your continued use of the Service constitutes acceptance of any changes.

11. Governing law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Queensland.
